Welcome to Big Daddy Cheer LLC (“BDC,” “we,” “us,” or “our”). We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy and Return & Refund Policy), govern your use of the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our policies. If you do not agree, please do not use the Services.
1. Access and Account
You represent that you are at least the age of majority in your state or province of residence and that any minors using the Services do so with your permission. You may be asked to provide information (e.g., email, billing, payment, and shipping details). You warrant that all information you provide is accurate and complete and that you have the rights necessary to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account. You may not transfer or license your account to anyone else.
2. Our Products (Made-to-Order)
Most products are custom printed on demand. We strive to display products accurately, but colors/appearance may vary due to device settings and print processes. Descriptions and availability are subject to change without notice. We may limit quantities or discontinue products at any time.
3. Orders
Your order is an offer to purchase. We may accept or decline any order at our discretion. Orders are accepted once payment is processed and we send an order confirmation. Because items are made-to-order, cancellations or changes may not be possible after production starts. If we decline or cancel an order, we’ll attempt to notify you using the contact details provided at checkout.
Your purchases are subject to our Return & Refund Policy. You represent that your purchases are for personal/household use and not for resale or export.
4. Prices and Billing
Prices, discounts, and promotions may change without notice. The price charged will be the price in effect at the time of purchase and will appear on your confirmation. Unless stated otherwise, prices exclude taxes, shipping/handling, and any customs or import charges.
You agree to provide current, complete, and accurate purchase and account information and to promptly update it as needed. You warrant that you are authorized to use the payment method provided and that charges will be honored.
5. Shipping and Delivery
We use third-party carriers and print-on-demand fulfillment partners to produce and ship orders. Delivery dates are estimates and not guaranteed. We are not liable for delays outside our control (e.g., carrier issues, weather, customs). Title and risk of loss pass to you when the shipment is transferred to the carrier.
6. Intellectual Property
The Services and all content (including text, images, graphics, logos, video, audio, and their selection/arrangement) are owned by BDC or our licensors and are protected by intellectual-property laws. You may use the Services for personal, non-commercial use only. No license is granted except as expressly stated.
“Big Daddy Cheer,” “Legend in the Stands™,” and related logos/designs are trademarks of Big Daddy Cheer LLC. Other names and marks are the property of their owners and used with permission.
7. Optional Tools and New Features
We may provide access to third-party tools or features we do not control. You acknowledge these are provided “as is” and “as available” without warranties, and we are not liable for your use of them. Any new features are subject to these Terms.
8. Third-Party Links
The Services may link to third-party sites. We are not responsible for their content, policies, or practices. Accessing third-party sites is at your own risk—review their terms and privacy policies before engaging.
9. Relationship with Shopify
Our store is powered by Shopify. Sales are made directly between you and Big Daddy Cheer LLC. Shopify is not responsible for our sales, products, or customer service. You expressly release Shopify and its affiliates from claims arising from your transactions with us.
10. Privacy
Your use of the Services is subject to our Privacy Policy. Because our store is hosted by Shopify, certain data is processed by Shopify in accordance with the Shopify Privacy Policy.
11. Feedback and Reviews
If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such Feedback for any purpose. You represent you have the rights to grant this license and that your Feedback complies with applicable laws and these Terms. We may moderate or remove Feedback at our discretion.
12. Errors, Inaccuracies, and Omissions
From time to time, information on the Services may contain errors or omissions (e.g., pricing, availability, shipping times). We may correct or update information or cancel orders if information is inaccurate, without prior notice.
13. Prohibited Uses
You agree not to use the Services for unlawful, harmful, or abusive purposes; to infringe intellectual-property rights; to transmit malware or spam; to scrape or crawl; or to circumvent security features. We may suspend or terminate access for violations.
14. Termination
We may terminate or suspend your access at any time without notice. Sections that by their nature should survive termination (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will survive.
15. Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED BY BDC, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; SOME LIMITATIONS MAY NOT APPLY TO YOU.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BDC AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS (AND SHOPIFY AND ITS AFFILIATES) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS/REVENUE/SAVINGS; LOSS OF DATA; OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
17. Indemnification
You agree to indemnify, defend, and hold harmless BDC, Shopify, and our respective affiliates and personnel from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.
18. Severability
If any provision is unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force.
19. Waiver; Entire Agreement
Our failure to enforce any right does not waive it. These Terms, together with posted policies, constitute the entire agreement between you and BDC and supersede prior understandings.
20. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms without notice.
21. Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in or serving Tuscaloosa County, Alabama.
22. Headings
Headings are for convenience only and do not affect interpretation.
23. Changes to Terms
We may update these Terms from time to time. The “Last updated” date will reflect changes. Material changes will be notified as required by law. Your continued use of the Services after changes constitutes acceptance.
